THE EMPLOYER:
Our client is a US Fortune 500 Company.It is a global leader in automotive experience, building efficiency and power solutions.
The company is currently seeking a Senior Legal Counsel, focusing on the area of compliance, for its power solutions group, based in its Asia Pacific headquarters in Shanghai.
DUTIES & RESPONSIBILITIES:
The successful candidate will report to the General Counsel of Asia Pacific area.Duties include:
- Develop and implement due diligence process and other compliance programs to support the company’s distribution strategy in China
- Develop and implement antitrust guidelines and processes to ensure that the operations in China are in compliance with the Anti-Monopoly Law and the implementing regulations
- Develop and implement a trade compliance program to ensure that the operations in China are in compliance with Chinese import and export regulations and U.S. trade regulations
- Develop and implement due diligence process for suppliers to minimize the financial exposure and risk of reputation loss due to the illegal practices of suppliers in the areas of bribery, environmental protection, safety, and employment etc
- Develop and implement process and guidelines to ensure that the branding, marketing and promotional activities are in compliance with advertising and consumer protection regulations
- Develop and implement process for handling government investigations to ensure that the company’s interests are best protected while at the same time applicable laws and our ethical standards are followed
- Take the lead in compliance-related investigations for the region
- Provide legal support for Finance’s compliance initiatives
REQUIREMENTS:
- Law degree from a reputable law school(s)
- PRC bar qualification and / or any other overseas bar qualification is required
- 7+ years of legal experience in the areas of corporate law, sales and marketing, procurement, environment, employment law, and arbitration & litigation with international law firm, leading PRC law firm or legal division of MNC
- In-depth knowledge of up-to-date PRC law, especially in the areas of Greenfield projects and joint ventures
- Knowledge of US law including FCPA and export control regulations gained either in an international law firm and/or multinational company
- Excellent drafting and communication skills in both English and Chinese
- Solution-oriented, self-motivated and analytical
- Good interpersonal and time-management skills
- Strong business acumen
